You may click the link to switch the active language.<\/p><p><\/p>\n<h2 align=\"center\">Demarca\u00e7\u00e3o de Terras Ind\u00edgenas<\/h2>\n<p>No \u00faltimo dia 19.7.2017 foi aprovado pelo Presidente da Rep\u00fablica Parecer de autoria da Advocacia-Geral da Uni\u00e3o (\u201cAGU\u201d), determinando que todos os \u00f3rg\u00e3os da administra\u00e7\u00e3o p\u00fablica federal deem cumprimento \u00e0 decis\u00e3o proferida pelo Supremo Tribunal Federal (\u201cSTF\u201d) nos autos da A\u00e7\u00e3o Popular PET n\u00ba 3388\/RR, comumente conhecida como caso Raposa Serra do Sol, que fixou as \u201csalvaguardas institucionais \u00e0s terras ind\u00edgenas\u201d.<\/p>\n<p>No julgamento do caso, o STF, a partir da interpreta\u00e7\u00e3o conferida ao texto da Constitui\u00e7\u00e3o Federal, notadamente dos artigos 231 e 232,\u00a0<strong>al\u00e9m de autorizar a demarca\u00e7\u00e3o de novas terras ind\u00edgenas desde que a \u00e1rea pretendida j\u00e1 estivesse ocupada pelos \u00edndios quando da promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o Federal de 1988<\/strong>, fixou uma rela\u00e7\u00e3o de 19 condicionantes institucionais aos processos de demarca\u00e7\u00e3o, denominadas de salvaguardas institucionais, tendo por objetivo n\u00e3o apenas julgar o caso concreto, mas tamb\u00e9m estabelecer regras gerais para todos os processos demarcat\u00f3rios no pa\u00eds.<\/p>\n<p><a href=\"http:\/\/box2074.temp.domains\/~lawmecom\/\/wp-content\/uploads\/2017\/07\/terras-ind%C3%ADgenas.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Leia mais\u00a0<\/a><\/p>\n<hr \/>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Sorry, this entry is only available in Portugu\u00eas.
