You may click the link to switch the active language.<\/p><p><\/p>\n<h2>STF modifica entendimento e afasta penhora de im\u00f3vel de fiador de contratos de loca\u00e7\u00e3o para fins comerciais<\/h2>\n<p>Em 12\/06\/2018 a 1\u00aa Turma do Supremo Tribunal Federal retomou julgamento que discutiu a penhorabilidade do \u00fanico im\u00f3vel do fiador de contrato de loca\u00e7\u00e3o.<\/p>\n<p>Por 3 votos a 2, prevaleceu o entendimento de que\u00a0<strong>n\u00e3o se pode penhorar<\/strong>\u00a0o \u00fanico im\u00f3vel do fiador para pagamento de d\u00edvidas decorrentes da\u00a0<strong>loca\u00e7\u00e3o comercial<\/strong>.<\/p>\n<p>A decis\u00e3o contraria o entendimento consolidado do Plen\u00e1rio do pr\u00f3prio Supremo Tribunal Federal que, em diversas oportunidades, se manifestou pela constitucionalidade do art. 3\u00ba, inciso VI da Lei n\u00ba 8.009\/90 no sentido de permitir a penhora do bem de fam\u00edlia do fiador de contrato de loca\u00e7\u00e3o, independentemente da finalidade (comercial ou residencial). O precedente cria instabilidade nas rela\u00e7\u00f5es locat\u00edcias e representa risco para a garantia de adimplemento dos contratos em vigor.<\/p>\n<p>Mattos Engelberg recomenda a revis\u00e3o dos contratos de loca\u00e7\u00e3o existentes e a eventual substitui\u00e7\u00e3o da garantia locat\u00edcia, estando dispon\u00edvel para prestar o aux\u00edlio necess\u00e1rio.<\/p>\n<hr \/>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Sorry, this entry is only available in Portugu\u00eas.
