You may click the link to switch the active language.<\/p><p>O Supremo Tribunal Federal (STF), ap\u00f3s quase dois anos desde o reconhecimento da exist\u00eancia de repercuss\u00e3o geral de recurso envolvendo a imprescritibilidade da pretens\u00e3o de repara\u00e7\u00e3o civil decorrente de danos ambientais, decidiu, em vota\u00e7\u00e3o virtual finalizada na \u00faltima sexta-feira (17), que a responsabilidade civil por danos causados ao meio ambiente \u00e9 imprescrit\u00edvel e, portanto, pode ser reconhecida mesmo ap\u00f3s d\u00e9cadas.<\/p>\n<p>A vota\u00e7\u00e3o, contudo, n\u00e3o foi un\u00e2nime. Dos 9 (nove) ministros presentes \u2013 considerando que a ministra Carmem Lucia n\u00e3o registrou voto e Celso de Mello est\u00e1 de licen\u00e7a \u2013, apenas Gilmar Mendes, Marco Aur\u00e9lio e Dias Toffoli foram contr\u00e1rios \u00e0 imprescritibilidade. O ministro Roberto Barroso, por sua vez, apesar de ser favor\u00e1vel \u00e0 referida tese, indicou haver ressalvas para que o exerc\u00edcio do direito \u00e0 repara\u00e7\u00e3o seja exercido, as quais estar\u00e3o dispon\u00edveis apenas ap\u00f3s a publica\u00e7\u00e3o do ac\u00f3rd\u00e3o. Os demais ministros acompanharam o voto do relator Alexandre de Moraes.<\/p>\n<p>A tese encaminhada ao STF est\u00e1 fundamentada em diversos outros casos j\u00e1 julgados pelo Superior Tribunal de Justi\u00e7a (STJ) sobre o assunto. Em um dos casos mais not\u00f3rios, a ministra Eliana Calmon entendeu que \u201c[s]e o bem jur\u00eddico \u00e9 indispon\u00edvel, fundamental, antecedendo a todos os demais direitos, pois sem ele n\u00e3o h\u00e1 vida, nem sa\u00fade, nem trabalho, nem lazer, considera-se imprescrit\u00edvel o direito \u00e0 repara\u00e7\u00e3o\u201d. Nesse sentido, o principal fundamento da tese \u00e9 de que sem regenera\u00e7\u00e3o ou repara\u00e7\u00e3o, o dano ambiental se perpetua indefinidamente, n\u00e3o encerrando seus efeitos no momento da conduta praticada pelo causador do dano.<\/p>\n<p>O ac\u00f3rd\u00e3o, proferido no \u00e2mbito do Recurso Extraordin\u00e1rio n\u00ba 654.833, ainda se encontra pendente de publica\u00e7\u00e3o e de oposi\u00e7\u00e3o de eventuais embargos de declara\u00e7\u00e3o.<\/p>","protected":false},"excerpt":{"rendered":"<p>Sorry, this entry is only available in Portugu\u00eas.
