SECEX initiates antidumping investigation on Brazilian imports of nitrile rubber (NBR) from South Korea and France
The Secretariat of Foreign Trade (“SECEX”) of the Ministry of Industry, Foreign Trade and Services published Ordinance No. 37 on the Official Gazette of June 26th, 2017, initiating an antidumping investigation regarding the Brazilian imports of nitrile butadiene rubber (NBR), product commonly classified under item 4002.59.00 of the Mercosur Common Nomenclature (“NCM” – HS based), originating from South Korea and France. The petitioner is Nitriflex S.A. Indústria e Comércio.
The product subject to investigation is the nitrile butadiene rubber (NBR), non-hydrogenated and non-oil extended, with an acrylonitrile content greater than or equal to 20% and less than or equal to 50%. Liquid NBR not within the scope of this investigation. NBR is utilized in applications where good mechanical properties and good resistance to dynamic fatigue is necessary, as well as when good resistance to oils or gasoline is required. For this reason, the product is used by the industry as a whole, with special focus on the automotive industry, as well as the mineral oils sector.
For the purpose of initiating the investigation, the authority calculated the following dumping margins:

Interested parties shall receive questionnaires indicating the information necessary to the investigation and shall have a 30-day deadline for response, counting from the date of receipt of the notification. The participation of interested parties shall be made through legal representatives before the Department of Trade Remedies (DECOM). Other parties who consider themselves as interested in the proceeding shall file a request for participation within a 20-day deadline counting from the beginning of the investigation.
