Brazilian Government initiates dumping investigation on imports of PET films from Bahrein and Peru

The Secretariat of Foreign Trade (“SECEX”) of the Ministry of Industry, Foreign Trade and Services (“MDIC”) published Notice of Initiation No. 68 on the Official Gazette of January 2, 2018, launching an antidumping investigation on Brazilian imports of PET films from Bahrein and Peru. The product is commonly classified under items 3920.62.19, 3920.62.91 and 3920.62.99 of the Mercosur Common Nomenclature – NCM. The petitioner is Terphane Ltda., responsible for 100% of the national production of PET films during the period of dumping investigation (July 2016 to June 2017).

The product under investigation was defined as biaxially oriented films, sheets, foils and strips of poly (ethylene terephthalate), of a thickness of 5 micrometers or more, and not more than 50 micrometers, metallized or not, referred on the investigation as simply PET films. PET films are commodities produced by the polyester film industry, used in the flexible packaging conversion industry and in certain industrial applications such as demoulding of tiles and insulation of electrical and telephone cables.

To initiate the investigation, the national authority calculated the following absolute and relative dumping margins:

Interested parties will receive questionnaires indicating the information necessary to the investigation, and shall have a 30-day deadline for response, counting from the date of notification. Interested parties may participate in the investigation through legal representatives duly registered before the Department of Trade Remedies (“DECOM”). Other parties who consider themselves as interested in the proceeding shall file a request for participation within a 20-day deadline counting from the beginning of the investigation.
